These terms are an agreement between The Leads Foundry LLC, doing business as The Leads Foundry ("we", "us"), and the business or network that buys phone calls from us ("you", "the buyer").
You accept these terms when you agree in writing to a price per call and a connected-time threshold, or when you accept the first call we route to you, whichever happens first. If you are agreeing on behalf of a company, you are saying you have the authority to do that.
We build and operate local-service websites, rank them in organic search, and route the phone calls those sites produce to buyers. When a caller dials a number on one of our sites, our routing platform connects that call to one buyer.
We are not an agency. We do not build websites for you, run your ads, manage your Google Business Profile, or work on any property you own. The sites stay ours. What you buy is the call.
We sell no lead forms and we make no outbound calls or texts. Every call is dialed by the caller.
You pay a fixed price per qualified call. A call is qualified when the caller stays connected past the threshold agreed in writing before the first call routes. Wrong numbers, spam, and hang-ups below the threshold are not billed.
The price and the threshold are set per service and market. Neither changes without written notice to you first.
We invoice weekly for the calls that qualified in that week. Every billed call appears on your ledger with the number dialed, market, time, duration, and a recording.
To dispute a call, tell us within 7 days of the invoice it appears on. We review the recording and the call record and either credit the call or explain why it stands. Calls not disputed within 7 days are final.
Calls are exclusive. One call goes to one buyer. We do not split a call, sell a recording, or route the same caller to a second business. A call we cannot attribute to a site and market is never assigned to any buyer and is never billed.
You set a daily cap on calls and can change it. You can pause routing at any time, for any reason, including being booked out. Pausing stops calls; it does not cancel invoices for calls already delivered.
There is no minimum term and no contract length. Either side can end this agreement at any time with written notice. We may pause or end routing if calls go unanswered, invoices go unpaid, or the obligations above are not met.
Call volume comes from organic search, which we do not control. We do not promise a number of calls per day, week, or month, and we do not promise that any call becomes a job, a sale, or revenue. Past volume in a market is a record of what happened, not a forecast.
We may stop building or operating any site at any time, which may reduce or end the calls from that market.
Calls are recorded. Callers hear a recording notice at the start of every call. You receive the recording and the call record for each call billed to you.
Inside our company, recordings are accessible to the operator and to the call-routing provider that stores them. We do not sell recordings, and we do not give a recording of your call to another buyer.
We keep recordings and call records for six months, then delete them. After deletion we cannot review a disputed call, which is one reason the 7 day dispute window is short. Our handling of caller information is described in the privacy policy and the call recording notice.
We provide the service as it is. To the extent the law allows, we are not liable for lost profits, lost business, or any indirect or consequential damages. Our total liability for any claim is limited to the amount you paid us for calls in the six months before the claim.
You are responsible for what you do with the calls and the caller information we send you. You agree to cover us for claims that come from your use of caller data, your calls back to callers, your marketing, or your services.
These terms are governed by the laws of the State of Colorado, without regard to its conflict of law rules. Disputes go to the state or federal courts located in Colorado.
We may update these terms. If a change affects price, threshold, billing, or your obligations, we tell you in writing before it applies to you. Continuing to accept calls after that notice is acceptance of the updated terms.
